PETITION FOR DECREE OF DISSOLUTION OF MARRIAGE
TO: The above named High Court; The Petitioner whose address is at No. 8, Ladipo Bateye Street GRA, Ikeja, Lagos State and who is Physician by occupation petitions the Court for a decree of dissolution of Marriage against the Respondent, Mojisola Oluyemisi Obasanjo whose address is No. 2, Adetunji Adeoba Street, GRA, Ikeja, Lagos State and who is a housewife by occupation on the ground that their marriage has broken down irretrievably.
MARRIAGE:
- The petitioner then a bachelor was lawfully married to the Respondent then a spinster at the Archbishop Vinning Memorial Church, Ikeja, Lagos on the 29th April 2000.
- The surname of the Respondent immediately before the marriage was Onabanjo.
BIRTH OF PETITIONER AND RESPONDENT:
- The Petitioner was born on 20th November 1971 in Ibadan and the Respondent was born on the 4th November 1976 in New York, NY, USA.
DOMICILE FOR RESPONDENT:
- The petitioner is within the meaning of the Act, domiciled in Nigeria. The facts on which the court will be asked to find that the Petitioner is so domiciled are as follows:
- The Petitioner is a Nigerian domiciled of Origin being of domiciled Nigerian percentage
- The Petitioner has neither changed nor abandoned that domicile
COHABITATION:
- Particulars of the places at which and periods in which the Petitioner and the Respondent have cohabitated are as follows:
- Immediately after marriage, in the USA and November 2002
- At No. 8, Okotie Eboh Street, between Nov. 2002 and Dec. 2003
iii. Finally at No. 8, Ladipo Bateye Street, GRA, Ikeja, Lagos State, between Dec. 2003 and November 2004.
- The date on which and circumstance in which cohabitation between the Petitioner and the Respondent last ceased are as follows:
On the 2nd December 2004, the Respondent left the marital home due to irreconcilable differences with the Petitioner and never came back and cohabitation between the parties ceased from that date as they have both been living apart since that day.

PREVIOUS PROCEEDINGS:
- Since the marriage there have not been any previous proceedings in Court between the Petitioner and the Respondent.
CONDONATION, CONNIVANCE AND COLLUSION:
- The Petitioner has not condoned or connived at the grounds specified in this petition and is not guilty of collusion in presenting this petition.
- PROPOSED ARRANGEMENTS FOR CHILDREN
EDUCATION
- The children will continue in their school and progress to the higher institution of learning in future to the best of their ability at the cost of the petitioner.
- MORAL OBLIGATION: The two children will continue to be brought up in the Christian faith.
iii. MAINTENANCE: The Petitioner has been and is responsible for the school fees, books and other relevant materials of the two children as well as general expenses and the Petitioner shall be willing to continue the payment of the school fees, books and other relevant materials of the children as well as general expenses.
- CUSTODY: The two children of the marriage have lived hitherto with the Respondent at No. 2, Adetunji Adeoba Street, GRA, Ikeja, Lagos State and they be ordered to continue living with the Respondent until adulthood.
- ACCESS: The Respondent will allow access of the children to the Petitioner during School Holidays.
- GROUND UPON WHICH RELIEF IS SOUGHT: That the Respondent has deserted the Petitioner for a continuous period of 1 year immediately preceding the presentation of the Petition.
The marriage has broken down irretrievably.
ORDERS SOUGHT: The Petitioner seeks the following orders:
- A decree of dissolution of the marriage.
